NOCFO Kumppaniohjelman Ehdot ja Säännöt

1. Johdanto

Nämä ehdot (”Sopimus”) säätelevät NOCFO Kumppaniohjelmaan (”Ohjelma”) osallistumista. Liittymällä Ohjelmaan kumppani (”Kumppani”) hyväksyy nämä ehdot

2. Määritelmät

  • Kumppani: Henkilö tai yritys, joka on hyväksytty osallistumaan Ohjelmaan.
  • Asiakas: Uusi käyttäjä, joka rekisteröityy ja maksaa NOCFO-palvelusta Kumppanin markkinointitoimenpiteiden seurauksena.
  • Komissio: Provisio, jonka Kumppani ansaitsee hyväksytyistä asiakashankinnoista.
  • Maksuraja: Vähimmäismäärä, joka Kumppanin tulee ansaita ennen maksun suorittamista.

3. Kelpoisuus

Ohjelmaan voivat osallistua laillisesti ja eettisesti toimivat henkilöt ja yritykset. NOCFO pidättää oikeuden hyväksyä tai hylätä hakemuksia ilman erillistä perustelua.

3. Kumppanin Velvollisuudet

  • NOCFO-palveluiden edistäminen laillisin ja eettisin markkinointikeinoin.
  • Väärien tai harhaanjohtavien väittämien välttäminen.
  • Kaikkien sovellettavien lakien ja säännösten noudattaminen.
  • NOCFO-brändin avainsanoihin ei saa tehdä hakukonemainontaa.
  • Spämmin, luvattomien sähköpostien ja harhaanjohtavien menetelmien käyttö on kielletty.
  • Kumppani on vastuussa kaikista markkinointitoimistaan ja niiden laillisuudesta.

4. Komissiot ja Maksut

  • Kumppani ansaitsee provision jokaisesta uudesta asiakkaasta, joka tilaa NOCFO-palvelun.
  • Provision suuruus ja maksuaikataulu määritellään erikseen.
  • Maksu suoritetaan vain, jos asiakas on maksanut NOCFO:lle ja ei ole perunut tilaustaan määritellyn ajan sisällä.
  • Maksut suoritetaan 15 päivää kuukauden päättymisen jälkeen, jolloin asiakas on suorittanut maksunsa tai laskun eräpäivään mennessä.
  • Maksut suoritetaan pankkisiirrolla tai PayPalilla, kun minimimaksuraja täyttyy.
  • Eri kampanjoilla voi olla erilaiset käytännöt koskien kestoa, alennuksia ja muita ehtoja.
  • Mahdollisissa maksukiistoissa Kumppanin tulee ottaa yhteyttä NOCFO:hon 30 päivän kuluessa maksun suorittamisesta.

5. Kielletyt Toiminnat

Kumppani ei saa:

  • Käyttää vilpillisiä keinoja provisioiden hankkimiseen.
  • Esittää vääriä tietoja tai käyttää NOCFO-brändiä luvattomasti.
  • Markkinoida NOCFO:ta aikuisviihde-, uhkapeli- tai laittomilla sivustoilla.
  • Yrittää kiertää seurantajärjestelmää.

NOCFO pidättää oikeuden peruuttaa kaikki kertyneet palkkiot, jos Kumppani rikkoo sääntöjä.

6. Sopimuksen Päättäminen

  • NOCFO pidättää oikeuden lopettaa Kumppanin osallistumisen välittömästi, jos näitä ehtoja rikotaan.
  • NOCFO voi myös irtisanoa sopimuksen 30 päivän irtisanomisajalla ilman erityistä syytä.
  • Kumppani voi erota ohjelmasta ilmoittamalla siitä kirjallisesti NOCFO:lle.
  • Mikäli sopimus päätetään sääntörikkomuksen vuoksi, NOCFO:lla on oikeus pidättää maksut.

7. Vastuu ja Vahingonkorvaus

  • NOCFO ei vastaa epäsuorista vahingoista, jotka syntyvät Ohjelmaan osallistumisesta.
  • Kumppani sitoutuu korvaamaan NOCFO:lle kaikki vaateet, jotka aiheutuvat sen markkinointitoimista.
  • NOCFO ei takaa mitään tiettyä tulotasoa tai ansaintamahdollisuutta Kumppanille.
  • NOCFO ei ole vastuussa teknisistä ongelmista tai seurantajärjestelmän häiriöistä, jotka voivat vaikuttaa provisioiden kertymiseen.

8. Muutokset

NOCFO pidättää oikeuden muuttaa näitä ehtoja milloin tahansa.Muutoksista ilmoitetaan Kumppanille sähköpostitse tai verkkosivujen kautta. Jatkamalla osallistumista Kumppani hyväksyy muutokset. Mikäli Kumppani ei hyväksy muutoksia, hänen tulee irtisanoa sopimus ennen muutosten voimaantuloa.

9. Sovellettava Laki

Näihin ehtoihin sovelletaan Suomen lakia. Mahdolliset riidat pyritään ratkaisemaan neuvotteluin. Mikäli sopuun ei päästä, riidat käsitellään Suomen yleisissä tuomioistuimissa, ensisijaisesti Espoon käräjäoikeudessa.

NOCFO Affiliate Program Terms and Conditions

1. Introduction

These terms (”Agreement”) govern participation in the NOCFO Affiliate Program (”Program”). By joining the Program, the affiliate (”Affiliate”) agrees to these terms.

2. Definitions

  • Affiliate: A person or company approved to participate in the Program.
  • Customer: A new user who registers and pays for an NOCFO service as a result of the Affiliate’s marketing efforts.
  • Commission: The fee earned by the Affiliate for approved customer acquisitions.
  • Payment Threshold: The minimum amount the Affiliate must earn before payment is processed.

3. Eligibility

The Program is open to individuals and businesses that operate legally and ethically. NOCFO reserves the right to approve or reject applications without justification.

4. Affiliate Responsibilities

  • Promote NOCFO services using legal and ethical marketing practices.
  • Avoid false or misleading claims.
  • Comply with all applicable laws and regulations.
  • Do not conduct search engine advertising on NOCFO brand keywords.
  • Spam, unauthorized emails, and deceptive marketing practices are prohibited.
  • The Affiliate is responsible for the legality of their marketing activities.

5. Commissions and Payments

  • The Affiliate earns a commission for each new customer who subscribes to an NOCFO service.
  • The commission rate and payment schedule are determined separately.
  • Payments are made only if the customer has paid NOCFO and has not canceled their subscription within the specified period.
  • Payments are processed 15 days after the end of the month in which the customer has made the payment or by the invoice due date.
  • Payments are made via bank transfer or PayPal when the payment threshold is met.
  • Different campaigns may have varying terms regarding duration, discounts, and other conditions.
  • In case of payment disputes, the Affiliate must contact NOCFO within 30 days of payment processing.

6. Prohibited Activities

The Affiliate must not:

  • Use fraudulent means to earn commissions.
  • Provide false information or use the NOCFO brand without authorization.
  • Market NOCFO on adult, gambling, or illegal websites.
  • Attempt to circumvent the tracking system.

NOCFO reserves the right to cancel all accumulated commissions if the Affiliate violates these rules.

7. Termination of Agreement

  • NOCFO reserves the right to terminate the Affiliate’s participation immediately if these terms are violated.
  • NOCFO may also terminate the agreement with a 30-day notice without specific cause.
  • The Affiliate may leave the program by providing written notice to NOCFO.
  • If the agreement is terminated due to a violation, NOCFO has the right to withhold payments.

8. Liability and Indemnification

  • NOCFO is not liable for indirect damages resulting from participation in the Program.
  • The Affiliate agrees to indemnify NOCFO against any claims arising from their marketing activities.
  • NOCFO does not guarantee any specific income level or earning potential for the Affiliate.
  • NOCFO is not responsible for technical issues or tracking system failures that may affect commission accrual.

9. Amendments

  • NOCFO reserves the right to amend these terms at any time.
  • Changes will be communicated to the Affiliate via email or through the website.
  • By continuing participation, the Affiliate accepts the changes.
  • If the Affiliate does not accept the changes, they must terminate the agreement before the changes take effect.

10. Governing Law

These terms are governed by Finnish law. Any disputes shall be resolved through negotiations. If no agreement is reached, disputes will be handled in Finnish courts, primarily in the Espoo District Court.
